This terms and Conditions govern your access or use of Multi-sided Digital Marketplace Platform(“DMP”) through mobileapp (“SWEN APP”) and web (“SWEN WEB”) and any related content and/or services made available within Sri Lanka by “Smart Wireless Engineering Network (Pvt) Ltd.(“SWEN”)”
By accessing or using the services you confirm your total agreement of Terms and Conditions to be bound by listed terms. If you do not agree to these Terms, you may not access or use services related to this DMP.
The Marketplace Platform & Services
Smart Wireless Engineering Network (Pvt) Ltd (“SWEN”) operates Multi-sided Digital
Marketplace Platform in number of forms including Mobile and/or Web based
application. This mobile application (SWEN APP) can be downloaded from Play/App
Store – Android or Apple. Also direct web users can use the Web (www.swen.lk). This
DMP enables you to receive services rendered by SWEN that facilitate your connection
to independent third-party providers who will fulfil your service and/or product needs.
These third-party providers are added to the platform based on their qualification &
experience, but are not employees or contracted agents of SWEN. It is
customers/clients responsibility to explain his/her total requirement at once in the form
of documents (RFP, sketch, building plan ect) and/or photos as SWEN select best thirdparty
provider based on this requirement which enable customer to have a better
selection of providers to fulfil his needs. Using DMP for other than intended use is
prohibited and may result in your account being de-activated.
Corporate customers who has the needs for large projects, large installation work, large
quantity of items or need a service of the service provider/contractor/MSP service for a
desired time frame can use the Web interface – “Corporate Client” section to obtain the
necessary quotations, items and services.
Ownership
Operation of the DMP and its related services and pricing policy shall remain property of
SWEN. Neither these terms of use of services grant you rights to modify any service or
pricing related but can suggest SWEN through written media electronically or other
means. SWEN owns the right to alter this terms and conditions without your consent.
You may use SWEN trademarks, service marks on any social media account or web sites.
Access and Use of Services
In order to use most accepts of the services you must register and maintain an active
Company or Personal user account through SWEN APP or SWEN WEB. In order to have
full access registration require you to submit personal information such as name,
address, mobile number, ID number and valid payment method for personal account
and company name, address, contact number, BR details and valid payment method for
company/corporate account. In all the events it is your responsibility to provide
accurate up to date information and maintain security with your user name & password.
You will need data network access to use the services is solely your responsibility. All
your personal data will be protected with industry/commercially acceptable solutions,
but since data transmission between our platform and your device happens over the
internet and data transmission through internet or electronic storage is not 100% secure
and/or reliable, we can’t grantee of absolute security.
Once you are authorized with a user name and password or sign in through Google
account, you can immediately request for services profitably through SWEN APP. Once
request with all the details are received for a Maintenance job (“Repairing of existing
system with or without any additional items”) SWEN will screen the third-party
providers and select the best based on an algorithm accounting to geographical area,
area of work, provider rating, experience and cost is notified to the user. Client can
select the contractor/MSP based on cost/star rating or any other as he/she wish way.
This service price or cost notified by MSP to you purely depends on the service request
description you as user/customer/client wrote at the time of requesting the job and
might increase at the time of physical inspection due to unforeseen work by part of the
customer or due to additional items needed to carry out the job. In such an event as
client/customer, you are advice to have a prior discussion on cost estimate with
MSP/service provider and agree before granting the job. If for any reason both parties
can’t agree and come to a conclusion of the amount customer is advice to pay
inspection & transport charges to MSP which is currently Rs.1000/- in the event the job
is not granted to MSP. In a dispute SWEN has the final decision-making power in all
corners.
In the event of an installation related or large project work (“Total new work to be
carried out or addition done to an existing system”), client needs to have approved Web
interface – “Corporate Client” section access to obtain the necessary quotations, items
and services which will require a pre determine registration fee depending on size of the
work, number of jobs, size of the organization as determine and agreed between SWEN
and Client/customer. SWEN will forward best 3 third-party providers with details
including the cost or quotation for user to select the option.
In any event service user/customer/client agreed to provide suitable working
environment, access permissions and supervise the work carried out, keeping eye of
valuables which can be stolen, before approving the final sign off/closing/paying for the
job. Any damages happen as negligence as a part of third-party
provider/contractor/MSP must be informed immediately and charge from him. In a
dispute SWEN has the final decision making power in all corners.
Payment
You understand use of any service through the MEP may result in a charge for the
service and for items you received/installed at your premises or declared premises.
Charges will have applicable taxes required by law (if any) which may change as per Sri
Lanka Finance ministry directive. In an event of Maintenance job user advice to use
electronic payment method as the preferred payment method and/or paying to the
third-party provider at the location is always an option. Once payment is done
electronic receipt will be sent to the user.
In “Corporate Client” Projects work once user agreed with the preferred third-party
provider 50% of the agreed amount needs to be deposited to SWEN through preferred
media to commence work. Balance 50% needs to be paid, half way in the project once
SWEN informed. Any delayed payments will delay your project and client will be paid in
any stage only SWEN received the written confirmation on electronic media or other
means on. It is customer/client responsibility to give project updates to SWEN who
assure contractor/MSP is paid only for completed work
Cancellation Policy
Customers/Clients who uses the APP can cancel the job at any stage by informing
(calling, SMS ect) SWEN. But it is advice to cancel before contractor/MSP had started
his journey to start your work or at your site to avoid discomfort to both parties. It is
advisable not to cancel jobs as requested by contactor/MSP as continuous cancellation
will lead yourself to bad category customer and might even limit the access of the
service platform/APP.
“Corporate Client” Projects work once user agreed and commences can be cancelled
with written request send to SWEN who will negotiate with contractor/MSP and cancel
his work. If such cancellation happens not due to contractor/MSP fault, discussed
amount will be paid to contactor/MSP due to his mobilization charges and amount of pulmonary work/cost incurred by him. In a dispute SWEN has the final decision making
power in all corners.

star rating in following scale.
